Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of FirstMove, a mobile application operated by Penguin Labs ("we," "us," or "our"). By downloading, installing, or using FirstMove, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the application. We reserve the right to update these Terms at any time, and your continued use of FirstMove after changes constitutes acceptance.

Description of Service

FirstMove is an iOS application designed for ambitious women who want to close the gap between dreaming and doing. The app provides:

  • Daily micro-action challenges across multiple personal growth paths
  • Progress tracking including streaks, badges, and milestone celebrations
  • A personal Wins Journal to document achievements
  • Personalized path selection for areas such as career, fitness, social connections, financial wellness, creativity, and mindfulness
  • Push notification reminders and encouragement

Account Registration

To use FirstMove, you must create an account using either email/password or Sign in with Apple. By creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access
  • Be at least 13 years of age

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Subscriptions & Billing

Free Tier

FirstMove offers a free tier that includes one active growth path, basic daily challenges, streak tracking, and limited badge collections.

Premium Subscription

Premium features are available through auto-renewable subscriptions. Subscription plans include monthly and annual options. Premium access includes:

  • Unlimited growth paths
  • Full challenge library with advanced challenges
  • Wins Journal with photo attachments
  • Complete badge and achievement system
  • Priority support

Billing Terms

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
  • You can manage and cancel subscriptions in your Apple ID Account Settings
  • Any unused portion of a free trial period will be forfeited upon purchasing a subscription

User Content

You retain ownership of content you create within FirstMove, including Wins Journal entries, photos, and profile information. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your content solely for the purpose of providing the FirstMove service to you.

You are responsible for ensuring that your content does not violate any third-party rights or applicable laws. We reserve the right to remove content that violates these Terms.

Acceptable Use

When using FirstMove, you agree not to:

  • Reverse engineer, decompile, or disassemble the application
  • Use the service for any unlawful or unauthorized purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Upload malicious content, viruses, or harmful code
  • Interfere with the proper functioning of the application
  • Violate any applicable local, state, national, or international law
  • Create multiple accounts to abuse free tier features
  • Scrape, harvest, or collect data from the application

Intellectual Property

The FirstMove application, including its design, features, challenge content, graphics, logos, and code, is owned by Penguin Labs and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

The FirstMove name, logo, and all related branding are trademarks of Penguin Labs. You may not use these marks without our prior written consent.

Disclaimers & Limitation of Liability

FirstMove is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will be uninterrupted, error-free, or secure.

FirstMove provides personal growth challenges and motivational content for informational purposes only. It is not a substitute for professional advice, therapy, or medical guidance.

To the maximum extent permitted by law, Penguin Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use FirstMove, including loss of data, personal progress, or streaks.

Termination

You may terminate your account at any time by deleting your account through the app settings. Upon termination:

  • Your access to FirstMove features will cease
  • Your personal data will be deleted in accordance with our Privacy Policy
  • Any active subscription must be separately canceled through Apple to avoid future charges
  • Challenge progress, streaks, and badges will be permanently lost

We reserve the right to terminate or suspend your account if you violate these Terms, with or without notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of FirstMove shall be resolved through binding arbitration in accordance with applicable rules, unless otherwise prohibited by law.
