Agreement to Terms

By downloading, installing, or using RiseAlarm ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

RiseAlarm is a loud alarm clock application designed for heavy sleepers. The App provides features including:

  • • Customizable alarm creation and management
  • • Mission-based alarm dismissal (Math, Shake, Face/Mirror)
  • • Loud alarm notifications with customizable sounds
  • • Premium features available through in-app purchase

Eligibility

You must be at least 13 years old to use RiseAlarm. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.

Use of the App

Permitted Use

You may use RiseAlarm for personal, non-commercial purposes in accordance with these Terms and applicable laws.

Prohibited Use

You agree not to:

  • • Reverse engineer, decompile, or disassemble the App
  • • Attempt to gain unauthorized access to the App or its systems
  • • Use the App in any way that violates applicable laws or regulations
  • • Interfere with or disrupt the App's functionality
  • • Use the App to create alarms that may cause harm or distress to others

Premium Features

RiseAlarm offers premium features that can be purchased through in-app purchases via the Apple App Store. Premium features include:

  • • Unlimited alarms (free version is limited)
  • • Face/Mirror Mission
  • • Custom alarm sounds
  • • Advanced mission settings

Payment Processing: All purchases are processed by Apple through the App Store. Payment terms, refunds, and subscription management are governed by Apple's terms and policies.

Privacy

Your privacy is important to us. RiseAlarm operates entirely on-device with no internet connection required, no external API calls, and no cloud storage. All data is stored locally on your device.

Disclaimers

No Warranty

RiseAlarm is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • • The App will always function without errors or interruptions
  • • Alarms will always sound at the exact time set
  • • Mission features will work perfectly in all conditions
  • • The App will wake you up in all circumstances

Important Safety Notice

RiseAlarm is designed to help heavy sleepers wake up, but it should not be relied upon as the sole method for waking up for critical appointments, medical treatments, or emergency situations. Always have backup alarm methods for important events.

Limitation of Liability

To the maximum extent permitted by law, Penguin Labs and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • • Loss of data or alarm settings
  • • Missed appointments or events due to alarm failure
  • • Any damages resulting from the use or inability to use the App
  • • Interruptions or errors in the App's functionality

Intellectual Property

RiseAlarm, including its design, features, and content, is owned by Penguin Labs and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. You may stop using the App at any time by deleting it from your device.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Penguin Labs operates, without regard to its conflict of law provisions.
